These terms and conditions govern the supply of products by Intrigue Noire to you " customer " when you place an order through our website, Intrigue Noire (referred to as our "Website"). They establish the legal framework for our business transactions with you as our client.

Before placing an order, you must agree to our General Terms and the Terms of Use (TOU) of our Website. We recommend that you read these documents carefully and save or print a copy for your records. If you do not agree to these terms, you will not be able to place an order.


1.3. Amendments
We reserve the right to amend and update these terms periodically. Revised versions will be posted on our Website. Any changes will be effective once published.THE CONTRACT BETWEEN YOU AND US IS GOVERNED BY OUR GENERAL TERMS IN FORCE AT THE TIME YOU PLACE AN ORDER.

Intrigue Noire Limited is registered in England and Wales under company number 14305375. Our registered office is 167-169 Portland Street, 5th Floor, London W1W 5PF.

If we need to contact you, we will use the email or postal address you provided in your order. The term "writing" includes emails and SMS.


3. OUR PRODUCTS


3.1. Product Information
Details about the products available on our Website, including references, ingredients (INCI names), safety handling and usage are provided for your information.

3.2. Personalised Products
"Personalised Products" refer to items made to your specifications or clearly personalised.

3.3. Product Variations
Products may vary slightly from their online images. While we strive to display colours and names accurately, we cannot guarantee that the colours you see on your device will perfectly match the actual product. Additionally, some of our latest label updates may not be immediately reflected online.


4. ORDERING AND CONTACT TERMS 


4.1. Placing Orders
Via Our Website: Orders can be placed through the shop section of our Website.


4.2. Delivery Restrictions
We  deliver within the UK, EUROPE and WORLDWIDE. We do not deliver to (a) hotels, (b) PO Box addresses, or (c) business premises.

 

4.3. Age Requirement
Orders are accepted only from customers aged 18 or over.

 

4.4. Consumer Sales
Our products are sold solely to individual consumers for personal use, not for business purposes. We limit the purchase of no more than 2 identical products per transaction. For monitoring purposes, your purchase history may be processed by Intrigue Noire. Non-compliance may result in transaction restrictions for unlimited period. For more information on your data rights, please refer to our privacy policy.

 

4.5. Personalisation Details
If your order includes Personalised Products, you are responsible for ensuring that all personalisation details are correct. Please note that Personalised Products cannot be returned.

 

4.6. Account Creation
When placing an order for the first time, you may choose to check out as a guest or create an account with us.

 

4.7. Order Acknowledgement
We will acknowledge receipt of your order with a confirmation email. However, this email does not signify acceptance of your order. Acceptance occurs when your order is dispatched, and you receive a dispatch email (refer to Clause 4.8).

 

4.8. Acceptance of Order
Your order is considered accepted once we email you to confirm dispatch. At this point, a contract is formed between us.

 

4.9. Order Rejection
If we cannot accept your order, we will notify you in writing and will not charge you for the product. Reasons for rejection may include out-of-stock items, resource limitations, errors in pricing or product descriptions, unmet delivery deadlines, or non-compliance with these terms.

 

4.10. Order Number
An order number will be assigned to your order upon acceptance. Please reference this number when contacting us regarding your order.

4.11. Cancelation  

Once you receive the order receipt confirmation you can no longer cancel or modify your order without prejudice to your statutory rights according to sections 9 and 11.

5. PAYMENT​

5.1 Product Pricing in Pounds Sterling (£)
We take all reasonable care to ensure the price of the product quoted to you is correct. The price display on our website is transparent and no additional charges should apply (close related to United kingdom only). Nonetheless, you are liable to pay  the product price, including any taxes,  service costs (e.g., for personalised products) and  associated delivery charges, if applicable.

5.2. Accepted Payment Methods
We accept payments in pounds sterling (£) by credit card (Visa, MasterCard) issued by banks within the European Union, by PayPal, by bank transfer (provided the paying bank account is held by you and domiciled in the European Union), or other payment methods as announced on our website. Please note, we do not accept payments by business bank cards online.

5.3. Payment Processing
You will be charged once your order has been placed and accepted by Intrigue Noire LTD. We will notify you via email once the products have been dispatched.

5.4. Failure to Process Payment
If your payment cannot be processed for any reason, your order will be canceled, and our contract with you will be terminated immediately. You will be informed of this in writing.

5.5. Payment Service Fees
You are responsible for any charges or fees applied by your card issuer, bank, or payment institution as a result of our processing yo
ur payment.

5.6. Electronic Invoicing
For each order, we will issue an electronic invoice based on the information you provided when placing the order. You agree to receive invoices in this electronic format.

6. SHIPPING AND DELIVERY

6.1. Local Delivery

The purchased products will be delivered exclusively in the UK (excluding Northern Ireland)

6.2 International Delivery

6.2. Courier

The products you order will be delivered by a courier service selected by us ("courier"). Deliveries will be made to the address specified in your order form. We cannot assume responsibility for any delivery issues arising from incomplete or incorrect address information provided by you. Please note that we do not deliver to P.O. boxes, freight forwarding addresses, or hotels.

6.3. Payment Policy and Shipping Requirements for Order Dispatch

Products will be dispatched only upon receipt of full payment. Incomplete payments may lead to delays or refusal to ship, without any liability on our part. To facilitate a smooth shopping experience, we kindly request your cooperation in ensuring that all payment and shipping information is accurate, thereby avoiding any delivery complications.

6.4. Guidelines for Verifying Shipment Upon Delivery

Upon receiving the products from the courier, we suggest that you (or your designated representative) take the following steps:

(i) Confirm that the number of packages delivered matches the quantity listed on the delivery note;

(ii) Check that the packages and their seals are intact, undamaged, dry, and unaltered in any way.

Any claims regarding damage to packages or discrepancies in the package count must be reported in accordance with applicable laws.

6.5. Customer Responsibility for Accurate Shipping Information and Correction Procedures

If a customer submits incomplete shipping information, please reach out to customer service at sales@intriguenoire.com with your reference number within 24 hours of your purchase. As outlined in section 6.3, providing incorrect shipping details may lead to delays. Additionally, customers may face shipping charges if the package is misrouted, delivered to the wrong address, or returned. In such cases, we reserve the right to cancel the order and issue a refund if the products are in our possession, subject to administrative fees. If products are lost, the customer will forfeit any rights to a refund. Placing an order is contingent on verifying all details to ensure proper delivery, so we recommend thoroughly reviewing all shipping information during the checkout process.

6.6. Product Delivery Policy and Force Majeure Conditions

We will make every reasonable effort to ensure that your purchased items arrive promptly, in line with the estimated delivery timelines provided. However, please keep in mind that each product is handcrafted and our operations are overseen by a single director, Priscilla Villeroy, who manages all aspects of production. During the checkout process, before you complete your order, please recognise that unforeseen circumstances—such as force majeure events (including pandemics, natural disasters, uncontrollable closures, strikes, riots, acts of war, or government actions related to these occurrences)—may affect delivery schedules and could result in delays. In light of these exceptional situations, we greatly appreciate your understanding and patience.

6.7. Delivery Delay Protocol and Customer Rights to Contract Termination

In the event of any delivery issues arising from circumstances mentioned in 6.5, you will be promptly notified. If the delivery does not occur within thirty (30) days, you will have the option to request a later delivery date. If we are unable to accommodate that request, you may choose to terminate the contract. In this case, we will refund all payments made under the contract within fourteen (14) days from the termination date.

7. PRODUCT OWNERSHIP, RISK, AND AUTHENTICITY 


7.1. Risk

Risk transfers to you or a designated recipient once you take physical possession of the products at the provided delivery address.
 
7.2 Authenticity and Intellectual Property  
All products are guaranteed authentic. Intrigue Noire trademarks, images, and intellectual property are protected by applicable laws.

 

8. RETURNS, WITHDRAWALS AND EXCHANGES 


8.1. Right of Withdrawal and Returns
You may withdraw from the contract without reason within 30 days of receiving the products. Withdrawal is not applicable to personalized or marked non-returnable items. To withdraw, inform us via email, post, or online before the withdrawal period ends. Refunds, minus specific fees, will be processed within 14 days of receiving the returned products.

8.2. Product Returns
Products must be in original, unused condition with tags and accessories intact. You bear the return shipping cost if not using the provided label. If conditions are unmet, products will be returned to you.

8.3. Exchanges
Exchanges are accepted within 30 days for different sizes or colors of the same item, per availability. Additional exchange requests require a new order.

 

9. PRODUCT QUALITY AND DEFECTS


9.1. Defects and Lack of Conformity
If a product has defects or does not match the description, contact us. Reimbursement, repair, or replacement is available based on the Consumer Rights Act, with limitations based on product handling and usage.

 

10. LIABILITY AND LEGAL OBLIGATIONS  
 

10.1. Limitation of Liability
We are responsible only for foreseeable losses due to contract breaches, not for business-related or unforeseeable losses. Liability exclusions include events beyond our control.

10.2. Applicable Law and Jurisdiction**  
10.3. Contracts are governed by the laws of England and Wales, with disputes subject to local jurisdiction.

11. Special Cases and Product Customisation


11.1. Personalised Products
Review your personalised requests carefully before submission. No returns on personalized products, and we reserve the right to refuse content that violates our standards.

10.2 Promotions and Special Offers  
Terms for promotions and special offers, including applicable dates, are specified online and cannot be combined with other offers.
